January 2023- Kiley Obtains Involuntary Dismissal of Claims in Negligence Actions

Jack Kiley obtained involuntary dismissals for his three clients in a negligence action in Clay County.  Plaintiff had sought liability against the clients for the criminal acts of a third party.  Kiley successfully argued the clients had no duty to Plaintiff.

October 2022- Kiley Obtains Summary Judgment & Sanctions in Premises Liability Case

Jack Kiley obtained summary judgment in a negligence action in Lawrence County arising from a fall through the roof of the client's barn that led to Plaintiff's injuries. Kiley successfully argued the client had no duty to Plaintiff. Kiley also sought and received sanctions as Plaintiff made material misrepresentations in discovery.

May 2022- Kiley Obtains Summary Judgment in Dram Shop Case

Jack Kiley obtained summary judgment in a dram shop action in Clay County.  Plaintiff had attempted to pursue a dram shop claim against clients not engaged in the commercial sale of liquor. Kiley successfully argued the Dram Shop Act did not apply to his clients.

April 2022- Kiley Obtains Summary Judgment in Motor Vehicle Case

Jack Kiley obtained summary judgment in a Coles County motor vehicle accident case involving a minor plaintiff who was injured while riding her bike.  Kiley successfully argued there were no facts to support the claim that his client was negligent when operating his vehicle at the time of the accident with the plaintiff and her bicycle.

December 2021- Kiley Obtains Summary Judgment in Deliberate Inference Claim

Jack Kiley obtained summary judgment in favor of his client, an optometrist, sued in federal court under a  deliberate indifference theory.  The plaintiff had alleged that the client showed deliberate indifference to plaintiff's allegedly serious medical condition.

November 2021- Kiley Obtains Dismissal of Will Contest

Jack Kiley obtained a dismissal of a will contest in Shelby County in favor of his clients, the co-executors of an estate.  It had been alleged that the co-executors had exerted undue influence on the testator resulting in a will that excluded the petitioner who then sought to invalidate the will.

October 2021- Kiley Obtains Summary Judgment in Negligence Action

Jack Kiley obtained summary judgment for his client in a negligence action based in McLean County, Illinois. The plaintiff sought damages for a leg fracture sustained when a garden hose pulled by the firm's client caused the plaintiff to fall. 

September 2021- Kiley Obtains Summary Judgment in Premises Liability Action

Jack Kiley obtained summary judgment for his client in a premises liability based in Madison County, Illinois. The plaintiff sought damages for numerous fractures sustained as a result of a fall in a parking lot adjacent to the client's place of business. 

August 2021- Kiley Obtains Dismissal of Defamation Claim and is Upheld by Appellate Court

Jack Kiley obtained a dismissal of a defamation claim based upon an email sent by a client. The Plaintiff appealed the dismissal, and after oral argument the decision was upheld by the Fourth District Appellate Court.

January 2021- Jordan T. Klein Becomes Partner in Firm 

Erickson, Davis, Murphy, Johnson & Walsh, Ltd, is excited to congratulate their newest partner, Jordan T. Klein. Jordan has been with the firm since October, 2015. He primarily practices in the areas of personal injury and property damage litigation, business transactions, estate planning, and municipal law.

Kiley and Klein Defend Client's Contract with the State of Illinois

Jack Kiley and Jordan T. Klein successfully intervened to protect their two clients' state contracts worth nearly $6 million. The matter was dismissed in the Central District of Illinois and upheld after argument in the United States Court of Appeals for the Seventh Circuit.

Kiley, Siudyla and Klein obtain $2.27 million judgment

Following a lengthy jury trial in federal court on a contract and products liability case, judgment was entered on behalf of the firm's client in the amount of $2.27 million. The defendant appealed and the United States Court of Appeals for the Seventh Circuit affirmed the District Court's judgment.

Kiley obtains a defense verdict in premises liability action

Following a multi-day jury trial, a jury delivered a defense verdict. The plaintiff had fallen down the client's stairs causing significant injury and had alleged the stairs were dangerous and not to code. Kiley successfully argued that plaintiff was responsible for her own injuries.

Siudyla obtains reversal from appellate court

In the Fifth Appellate District, Siudyla obtained a reversal of a domestic-battery conviction and sentence where the evidence demonstrated that the client's use of force was necessary to prevent or terminate his wife's trespass, and his use of force was reasonable.

Klein Granted Summary Judgement in Errant Golf Shot Case

Jordan T. Klein obtained summary judgment for his client in a property damage case held in Madison County, Illinois. The plaintiff sought damages for his broken patio door after Mr. Klein's client allegedly struck it with an errant golf ball from an adjacent golf course. 

Klein Obtains Defense Verdict in Negligence Maintenance Case

Jordan T. Klein wins judgment in favor of a local Shelbyville business at trial. The plaintiffs sought several thousand dollars in repair costs and claimed the local business negligently installed a defective appliance in their home and failed to diagnose and repair the unit.

Klein Obtains Defense Verdict in Property Damage Action

Jordan T. Klein obtained a favorable defense verdict on behalf of his client in a property damage action in a bench trial in St. Clair County, Illinois. The plaintiff sought damages for the repair of plaintiff's truck when it collided with the client's property.
